The Constitutional Court in Bucharest decided on Thursday that a suspended President can be dismissed with the vote of 50 percent plus one of the total votes registered in the referendum.
The Court thus decided the clause of non-constitutionality submitted by the Democratic Party against an opposition-supported amendment to the referendum law, that would help suspended President Traian Basescu’s opponents in their campaign to oust him.
The decision comes despite the Court has rejected similar amendments to the referendum law twice since the beginning of the year.
The amendment was initiated by the opposition Social Democrats and passed by the House of Deputies in March. It was previously legally stated that the President can be removed from office with the vote of half plus one of the total number of listed voters, not active voters. The previous rule would have made it fully impossible to have suspended but popular President Basescu ousted.
